An Act to Amend the Gaming Control Act
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 34 of the Gaming Control Act, chapter G-1.5 of the Acts of New Brunswick, 2008, is amended
(a) in subsection (1) by striking out the portion preceding paragraph (a) and substituting the following:
34( 1) On application in accordance with paragraph 207(1)(b) or (f) of the Criminal Code (Canada) by a charitable or religious organization to the Registrar or any other person or authority specified by the Lieutenant-Governor in Council, the Registrar or other person or authority may issue or renew a licence if the application is accompanied by
(b) by adding after subsection (1) the following:
34( 1.1) The application shall be made on a form provided by the Registrar.
2 Section 34.41 of the Act is amended by adding after subsection (2) the following:
34.41( 2.1) Despite subsection (2), in the case of a licensee whose licence was issued or renewed in accordance with paragraph 207(1)(f) of the Criminal Code (Canada), the Registrar, on written request by the licensee, may authorize the records to be kept outside the Province subject to any terms and conditions that the Registrar may impose.
3 Section 34.5 of the Act is amended by adding after subsection (3) the following:
34.5( 4) A charitable or religious organization that is a licensee in accordance with paragraph 207(1)(f) of the Criminal Code (Canada) shall use for charitable or religious purposes within the Province the net proceeds of tickets sold in the Province in a lottery scheme, in accordance with the requirements established by regulation.
34.5( 5) For the purposes of subsection (4), “net proceeds” means gross proceeds less the administrative expenses of conducting and managing the lottery scheme that are approved by the Registrar and the cost of the prizes offered in the lottery scheme.
4 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
